Earthquake SAFETY TIPS
Earthquakes can strike without warning, and being prepared for such a disaster can mean the difference between life and death. Here are some tips to help you and your loved ones make it through a quake:
- Those living in areas not prone to earthquakes can respond quickly to the plight of disaster victims in quake zones by complacently smirking and saying, "I told you so."
- To minimize loss and damage in a quake, try not to own things.
- Experiencing an earthquake is terrifying, but a majority of people caught in one do survive. During the tremors, try to resist the temptation to have sex with pets or houseplants.
- Practice your burrowing-out-from-under-40-tons-of-rubble skills ahead of time.
- Look out your window often. If you see a large, zig-zag-shaped crevasse moving rapidly from the horizon toward your home, step either to the right or the left.
- Do you have a treasured childhood toy? Perhaps a stuffed animal, such as a teddy bear? Well, let's see Mr. Bear help you now.
- For those who fear earthquakes, it may comfort you to know that a majority of the damage during the 1906 San Francisco earthquake did not come from the tremors themselves. Instead, it was from the raging, out-of-control fires that consumed most of the city.
- A doorway is the safest place to be during a quake. Eat, sleep and work in doorways.
- Be sure to mail your house insurance payments a full five business days before a major earthquake strikes.
- In the event of a quake, get under something heavy, such as a desk, a table or your uncle.
- If you are caught in a major earthquake in Southern California and are part of the entertainment industry, take a moment or two to reflect on how grossly you've wasted your life.

California's Tax Credit Monies May Go Fast!
CALIFORNIA'S TAX CREDIT MONIES MAY GO FAST
The $100 million allocated for California's first-time homebuyer tax credits may be depleted in about 10 to 20 days or sooner, according to C.A.R.'s Economics team. California's Franchise Tax Board (FTB) plans to begin accepting applications on May 1, 2010 for tax credits up to $10,000 for first-time homebuyers and for homes that have never been previously occupied. However, the total tax credit allocation for all taxpayers is $100 million for first-time homebuyers and $100 million for new homes, both on a first-come, first-served basis.
C.A.R.'s forecast of 10 to 20 days to deplete the $100 million allocation for first-time home buyers is based on estimated May sales figures and other parameters. It does not take into account the possibility that buyers scheduled to close escrow in April may delay closing until May to take advantage of the tax credit. If a shift in closings from April to May occurs, the first-time homebuyer tax credits may be depleted even more quickly than indicated above.
Applications for the California tax credit must be faxed to the FTB after escrow closes. The FTB will update its website when the 2010 application form and other information become available.
REALTORS® are reminded not to give their clients any tax or legal advice, such as the availability of funds under the California tax credit program. Agents should encourage their clients to seek specific advice from an accountant, attorney, or other professional as they deem appropriate.

No More State Tax on Forgiven Debt
Distressed homeowners no longer have to pay California state income tax on debt forgiven in a short sale, foreclosure, or loan modification. Enacted into law yesterday, Senate Bill 401 generally aligns California's tax treatment of mortgage debt relief income with federal law. For debt forgiven on a loan secured by a "qualified principal residence," borrowers will now be exempt from both federal and state income tax consequences. The existing federal exemption is for indebtedness up to $2 million, whereas the new California exemption is for indebtedness up to $800,000 and forgiven debt up to $500,000.
"Qualified principal residence" indebtedness is defined as debt incurred in acquiring, constructing, or substantially improving a principal residence. It includes both first and second trust deeds. It also includes a refinance loan to the extent the funds were used to pay off a previous loan that would have qualified.
The tax breaks apply to debts discharged from 2009 through 2012. Californians who have already filed their 2009 tax returns may claim the exemption by filing a Form 540X amendment.
Taxpayers who do not qualify for the above exemptions (e.g., second home or rental property) may nevertheless be exempt under other provisions. Most notably, taxpayers who are bankrupt are exempt from debt relief income tax. Also, taxpayers who are insolvent are exempt from debt relief income tax to the extent their current liabilities exceed current assets.

Walk Score - Helping homebuyers, renters, and real estate agents find houses and apartments in great neighborhoods.
One of the hottest buzz words in real estate these days is "walkability". A lot of people are looking for a home in a neighborhood where schools, restaurants, groceries, public transit and entertainment are located in walking distance. Beginning Feb. 22, 2010 all active listings on the MLS will include a link to Walk Score, a website providing select information for a specific property address. This score calculates the walkability of an address based on the distance from to nearby amenities. The results are provided in an interactive map format as well as detailed dropdown list. Additional features include walkability scores and related features for both major cities and their neighborhoods.
As a side note, San Diego is ranked 16th on their list of the most walkable neighborhoods in the top 40 U.S. cities! Please email me if you'd like to know how your home fares!

Expenses to Expect When Selling Your Home.

It is a known fact that when you purchase a home you will have many different expenses related to the sale. It is important to know as well that when you sell your home, you will also have expenses that will be required. Below is a list of some of the most common costs that come with selling your home.
Closing Costs: Although most of the closing costs are the responsibility of the buyer, the seller is expected to pay the property taxes and insurance up to the date of the closing, even if they’re not due yet. in addition, some buyers will ask the seller for help with other closing costs as part of the negotiations.
Realtor Commission: Typically there’s a 4 percent to 7 percent commission on the sale price of the house if you opt to go with an agent. Usually this rate is between 5 percent and 6 percent, so be sure to account for this cost when pricing your home and figuring up your expenses that come with selling your home.
Home Inspections: Although the buyer pays for the home inspection, it’s a good idea to get your own inspection before putting your house on the market. This way you’re aware of any hidden problems before selling. Also, you will probably be paying for a pest inspection.
Prepayment penalty: Many mortgages have prepayment penalties if you pay off the mortgage early. Be sure to examine your mortgage agreement and read the fine print.
Many homeowners are not aware of the costs involved with selling a home but there are some perks as well. With any home sale you are eligible for a tax write off of up to $250,000 gained in the sale of your home for a single owner, and $500,000 for married couples. This applies for most state taxes as well; check with a tax professional to get all the details of any tax credit that may be available to you and your situation.

Sellers: Disclose, disclose, disclose!

This week, I experienced yet another contract fall apart only days before closing. This time I was dealing with an investment property that sounded great on paper but when the buyer discovered the reality of what he was buying, the entire deal soured. It was a total disappointment from our camp because the only reason why this portfolio of properties are not closing is as a result of a lack of disclosure.
Regardless of what you’re selling, it is important to paint an accurate picture to buyers. You may be able to trick a few people into believing that your 25 year old Hyundai is as nice as a new Mercedes but when the buyer comes to see, touch, and feel, they’ll always walk away. The same holds true for real estate. Agents are notorious for “puffing” and so much so that it’s covered in real estate text books in pre and post licensing. Puffing is the act of over-stating a home’s attributes within certain limits.
When a home is small, it’s referred to as quaint.
When a home is near a highway, easy commute.
When a home is on fire, motivated seller…you get the idea.
The harm in puffing comes when you have to disclose what you’ve been saying isn’t at all accurate. Take this transaction: listed as a portfolio of occupied and rented properties - winner! The reality: two tenants are being evicted and 2 units are rented by the room. Until this week, the leases didn’t even exist. Also, the properties were sold as completely renovated, which again can disappoint when it comes to ones expectations as to what they’re anticipating.
In real estate, it’s best to disclose every bit of information up front, especially anything that may affect whether or not a buyer would make an offer. If not up front, what other time would be opportune to disclose improtant information regarding the transaction you’re working on….at closing, after closing, during the inspection, or never. Also, agents who play the “don’t ask, don’t tell” rule with regards to material facts will quickly discover that they are liable for what they knew and should have known. Sorry, my friend, ignorance isn’t an excuse.
I’m big on real estate disclosure because I like my job and I plan to be doing it for a very long time. Agents whom omit important details that are discovered by the seller later on are quickly ushered out of the business as a result of a number of lawsuits or sanctions by the real estate commission.
It’s a shame that my client wasted his time and money to discover the truth of what was being held back in the situation. For us, we’re now 30 days into a failed contract and have to start over to find another opportunity to sell this client. Had everything been as it was sold, we would be going to closing this week and everyone would be happy. Instead, because of a lack of property disclosure and probably too much puffing, it’s back to square one.

New Government Short Sale Program – Home Affordable Foreclosure Alternatives HAFA

What is this exactly? Well the government initially announced forthcoming plans and guidelines back in May 2009, which was a bit premature, to coincide with the loan modification program put into place (HAMP). Since then nothing had been mentioned until Nov 30, 2009. On this date guidelines were released for servicers to follow if they want to collect on government (Treasury) paid incentives for doing short sales for homeowners. This plan is set to go into effect April 2010.
Below is a list of commonly asked questions about this program.
How does it help homeowners?
• Foreclosure is postponed for 120 days while the property is for sale.
• Streamlined short sale and deed in lieu (DIL) process; predetermined listing price, 10 day approval timeframe
• Homeowners will receive $1500 for move out expenses in a Short Sale or DIL
• Homeowners will be released of all future claims from the lender, i.e. no deficiency rights
• Lender will pay all fees associated with sale including real estate commissions
Who is eligible?
• Properties that are primary residence
• First mortgage originated on or before January 1, 2009
• Mortgage is delinquent or default is reasonably foreseeable
• Current unpaid principle balance is equal to or less than $729,750
• The borrowers total monthly mortgage payment exceeds 31% of borrowers gross income
• Homeowners must have been evaluated for a HAMP loan modification first, but homeowner can still request a short sale or DIL.
What does a homeowner need to do?
• Hire a Licensed real estate broker familiar with HAFA guidelines to list property.
• Respond to lender request within 14 days to start program or they may not be eligible.
• Provide all information and sign HAFA documents required to verify program eligibility
• Cooperate with listing broker to actively market the property and respond to servicer inquiries
• Maintain the interior and exterior of the property in a manner that facilitates marketability.
• Work to clear any liens or other impediments to title that would prevent a sale
• Make reduced monthly payment stipulated by the lender if asked, or if applicable.

One of the things I love best about living in San Diego.



Living in San Diego definitely has it's benefits. Of course there is the weather and the beaches, but one of the things I love best is the variety of activities available. For example, I came into the office today and asked the proverbial question "how was your weekend?" One person enjoyed the sunshine as she ran in the Carlsbad Marathon:
My assistant took her kids to the local mountains to enjoy the snow (there was 3 ft of fresh powder!) on Saturday and went to the beach to enjoy the sunshine on Sunday. And us? We went to Monster Truck Jam (gotta love it!)

Kids Eat Free in San Diego
My assistant came in this morning all excited because last night she went to Islands restaurant and her kids ate for free. It got me thinking about other restaurants that may offer this. And my disclosure: Make sure to check with restaurants before going to see if special is current, as these specials tend to change.

Keep in mind that lunch and Happy Hour specials (often ½ off appetizers and drink specials) are more affordable than dinners! Another good deal is the all-you-can-eat buffets (such as Sizzler and many Asian buffets), especially when kids 2 and under eat for free.
